Consultation has concluded

In 2020, Upper Hutt City Council received a private plan change request for the rezoning of Riverside Farm at 29 Mangaroa Valley Road. At our Council Meeting on 21 October 2020, we decided to accept the private plan change request and start the statutory plan change process.

The proposed private Plan Change was notified on 27 January 2021 and submissions closed on Wednesday 10 March. Overall, seven submissions were received. We have prepared a Summary of Decisions Requested (Summary of Submissions) and now invite you to make further submissions in support of, or in opposition to, the submissions already received.

Any person representing a relevant aspect of the public interest and any person with an interest in the Plan Change greater than the interest the general public has, may make a further submission in support of or opposition to, any one or more of the previously received submissions.

Further submissions must be completed on the Further Submission Form (Form 6) and must state whether or not you wish to be heard on your submission. Copies of the Further Submission Form are available are available in the Supporting Documents section on the right of this page. Further submissions must be received by 5pm, Wednesday 26 May 2021.

Any person representing a relevant aspect of the public interest and any person with an interest in the Plan Change greater than the interest the general public has, may make a further submission in support of or opposition to, any one or more of the previously received submissions.

Please note: In addition to serving a copy of the further submission on the Upper Hutt City Council, a copy of the further submission must also be served on the person(s) who made the original submission to which the further submission relates. This must be done no later than 5 working days after providing the Upper Hutt City Council with the further submission.

Process for public participation

The process for public participation in the consideration of the proposal under the Act is as follows:

  • after the close of further submissions, Council will conduct a hearing if needed. Everyone who made a submission or further submission, and who requested to be heard, will be advised of the dates and times of the hearing and will be given an opportunity to attend and speak to the Council in support of their submission.
  • after considering the private plan change and undertaking a further evaluation of the plan change in accordance with section 32AA the Upper Hutt City Council
    1. may decline, approve, or approve with modifications the plan or change; and
    2. must give reasons for its decision; and
  • the local authority shall give public notice of its decision within 2 years of notifying the proposal and serve it on every person who made a submission and on the person who made the request at the same time; and
  • any person who has made a submission as well as the person who requested the private plan change has the right to appeal against the decision on the proposal to the Environment Court if,
    1. in relation to a provision or matter that is the subject of the appeal, the person referred to the provision or matter in the person’s submission on the proposal; and
    2. in the case of a proposal that is a proposed policy statement or plan, the appeal does not seek the withdrawal of the proposal as a whole.

The further submission phase closes at 5pm, Wednesday 26 May 2021.
